THE ELISABETH MANN-BORGESE  FELLOWSHIPS CALL FOR APPLICATIONS

 

The Elisabeth Mann-Borgese Ocean Prize is awarded annually, in memory of Elisabeth Mann-Borgese and her lifelong commitment to protecting the world’s oceans and seas, to persons whose work has contributed to protecting and preserving the oceans and the seas.

 

In the year 2009 the Prize was presented to Commissioner Joe Borg, then European Commissioner for Fisheries and Maritime Affairs, for his efforts to contribute to the creation of an Integrated Maritime Policy for the EU. Commissioner Joe Borg has decided to donate the prize money for the establishment of the Elisabeth Mann-Borgese Fellowships at the IMO International Maritime Law Institute (IMLI). The primary aim of these Fellowships is the funding of research projectson topics relating to the Oceans.

 

This call for applications for the first of such Fellowships is open to candidates interested in conducting research on topics relating to ‘The Oceans and the Doctrine of the Common Heritage of Mankind’.

 

 

Rules Governing the Award of the Fellowship and the Conduct of Research

 

1.  The Fellowships shall be administered by the IMO International Maritime Law Institute (IMLI).

 

2.  All candidates must complete the requisite Application Form which may be requested from the Institute or which is available on the Institute’s website.

 

3.  The Institute will only consider applications from candidates who possess a Post-Graduate Degree in Law from a recognized University and who also possess a proven ability to conduct legal research.

 

4.  Research under the Fellowship shall be conducted on a topic approved by the Institute relating to ‘The Oceans and the Doctrine of the Common Heritage of Mankind’. In particular, topics studied may include:

    (i)   The background to the concept of common heritage of mankind and the Deep Seabed;

    (ii)   Customary Law: Declaration of Principles Governing the Deep Seabed;

    (iii)  The Legal Regime Governing the Deep Seabed-Part XI of the UNCLOS, Resolutions I and II to the Final Act of the UNCLOS and the 1994 Agreement relating to the Implementation of Part XI of the UNCLOS;

    (iv)  The Machinery for Deep Seabed Mining: The International Seabed Authority ;

    (v)   Non-appropriation and the peaceful use of the Area;

    (vi)  Protection of the Marine Environment of the Area; and

    (vii) Bioprospecting, patentability and utilization of genetic resources of the sea beyond the limits of national jurisdiction.

 

5.  The research paper produced under the Fellowship shall meet the following requirements:

    (i)   The research paper shall be conducted in the English Language;

   (ii)   The length of the research paper shall be 15,000 words, including footnotes, but excluding bibliography and annexes;

   (iii)   The research paper shall follow the Guidance Notes on IMLI Dissertations;

   (iv)   The research paper must demonstrate originality;

   (v)   The research paper must contain a contribution to knowledge in the subject it deals with;

   (vi)   The research paper must attain an acceptable standard of literary presentation; and

   (vii)   When submitting the research paper the candidate must complete and sign a declaration provided by the Institute that the submitted work is his own.

 

6.  The candidate to be awarded the Fellowship shall be selected by a Selection Committee to be appointed by the Director of the IMO International Maritime Law Institute.

 

7.  The selected candidate will be duly notified of his selection.

 

8.  The selected candidate will be required to commence the research on 15 May 2012. The research will have to be completed by not later than 15 August 2012.

 

9.  There will be no requirement for the selected candidate to be based in Malta during the period of this research. However, if the selected candidate wishes to stay in Malta for the purpose of conducting the research, the Institute may provide accommodation at its premises at a subsidized cost. All other expenses will have to be borne by the candidate.

 

10.  The selected candidate will be required to submit a progress report on the research project on 15June 2012 and 15 July 2012. Such progress report shall be submitted to the Director of the Institute.

 

11.  The selected candidate will be entitled to 5000 Euros on the successful completion of the research. 25% of this sum will be awarded to the candidate upon selection. The remaining 75% will only be awarded on the successful completion of the research and on the Selection Committee recommending to the Director that the research paper submitted meets the requirements of Rule 5 above.

 

12.  If the research paper submitted does not meet the requirements of Rule 5 above, the selected candidate shall not be entitled to receive the balance payment of 75%. The candidate shall not be granted the opportunity of re-submitting the research.

 

13.  The decision of the Director and of the Selection Committee appointed by him shall be final in respect of all matters concerning the award of the Fellowship and the conduct of research thereunder.

15.  Applications may be submitted by post (air mail) or by e-mail to director [at] imli [dot] org.

   (i)  All applications must be accompanied by the following documents:

   (ii)  A letter of intent written by the candidate stating the candidate’s reasons for applying for this fellowship, his/her career objectives and how the said research will be beneficial to them in their future careers.  

   (iii)  Two letters of reference covering the candidate’s ability to undertake this fellowship. Referees should be persons who are not related to the candidate and who are familiar with the candidate’s character and qualifications. No member of the IMLI Resident Faculty will be permitted to issue any such reference letter on behalf of candidates.

   (iv)  Copies of all Educational certificates including the relevant Post-Graduate Degree certificate in Law.

   (v)  Copies of at least one research paper in proof the candidate’s ability to conduct legal research.

 

16.  Duly completed applications, together with the accompanying documents, must be received on or before 2 April 2012.
